Shimla (Dec 15) Shimla District Bar Association has decided to file review petition before Himachal Pradesh High Court to reconsider its decisions passed on December 15 in which their protest was declared illegal in the public interest.
Today Shimla Bar Association organized its general house here this morning and decided to move a review petitions to avoid any confrontation posed to it with the court decision.
A penal was constituted among the senior members of bar who was entrusted to frame and draft the review petitions so that Lawyers could not isolated on the court decision and continue their protest against the shifting of court complex to new place.
As it has been reported earlier that on Dec 15, 2010 Himachal Pradesh High Court has held that holding of bandh or hartal or calling for bandh or hartal is illegal and impermissible as it has the effect of interfering with the fundamental rights of the people.
Taking suo-moto note of protest by lawyers, the orders has been passed by the division bench comprising Chief Justice Kurian Joseph and Justice VK Ahuja on a petition of Shimla District Bar Association seeking suitable land for a new judicial complex.
The court was anguished by shifting of the stand by members of the district bar association, holding of “dharna” and abstaining from attending courts and calling for “Shimla Bandh” on December 10, 2010 by the lawyers while the matter is
sub-judice, and specially, since the previous orders of the high court dated May 10, 2007 regarding construction of judicial complex at Chakkar was not challenged by the bar association.
