Shimla: Himachal Pradesh High Court today set aside the bail granted by a fast-track trial court in Dharamsala to four students of Rajindra Prasad Medical College accused of ragging first year student Aman Kachru who died last year. It also directed the accused to surrender in the fast-track court at Dharamsala in Kangra district on Thursday.
The single-judge bench comprising Justice DD Sud ordered to cancel the bail after the court took suo motu action on July 20 taking cognizance of the ball granted to them by the trial court, asking government why their bail should not be cancelled. Accepting the plea of the counsel for the accused, the bench allowed them to surrender in the court by 10 am on Thursday. Earlier, it had ordered that the accused be arrested forthwith. The trail court has been directed to conduct day-to-day hearing without unnecessary adjournments.
The fast-track court had granted bail to the four accused – Ajay Verma, Naveen Verma, Abhinav Verma and Mukul Sharma – on July 17 after 16 months of custody. Later talking to reporters, advocate general RK Bawa said the bail was granted to the accused by the trail court in the middle of the case and it shouldn’t have been granted as there were chances that the accused could tamper with the evidence.
Kachru, 19, died on March 8, 2009, a few hours after being allegedly ragged by the four final-year students of Rajendra Prasad Medical College in Tanda town in Kangra district. The fast-track court has already listed the matter for next hearing on August 2.
The court has so far recorded the statement of 26 witnesses and now only the statements of some doctors and police personnel are to be recorded.
