HP HC slaps notices for non-compliance of its order by HPU

Himachal Pradesh High Court today took strong notice of non compliance of its order as it had issued notices to the Secretary Education and Vice Chancellor of Himachal Pradesh University. The court ordered Mr. R.D.Dhiman Principal Secretary Education, Rikant Baldi, Additional Chief Secretary, Finance to the government of Himachal Pradesh and Bajpai, Vice Chancellor and Rajinder Chauhan, Pro Vice Chancellor, HPU, Dinkar Burathoki, Director, Higher Education, M.S. Chauhan, Dean, Science faculty HPU, Krishan Vaidya, Dean, Visual & Fine Arts, HPU, Y.K. Sharma, Principal, Govt. Ayurvadic College, Paprola, Professor J.P. Nadain, Department of Business Administration, HPU, Chander Shakher resident of Sarkaghat, Raj kumari, Section Officer, Budget Branch, HPU, Bambar Thakur, Member of Legislative Assembly, Harish Janartha, Shyama Joshi, Associate Professor, Department of Foreign Language, HPU and Pankaj Lalit, Registrar, HPU issued show cause notice for non compliance of the orders of the Court.

 

A Division Bench comprising Chief Justice Mansoor Ahmad Mir and Justice Tarlok Singh Chauhan passed these orders on a Criminal Contempt petition filed by Sudhir Saklani. The petitioner has alleged in the petition that Himachal Pradesh University came out with advertisement on Oct 21. 2011 for filling up various posts of Assistant Professors. Thereafter, the University issued a corrigendum on June 27, 2012 with respect to the posts advertised and the eligibility criteria were changed. The petitioner further alleged that the said order was challenged in the court and the court was pleased to pass an interim order in the favor of petitioner. It was further pointed out by the petitioner that during the pendency of the petition university took a decision to disband the  advertisement dated Oct 21, 2011 and fresh process with respect to all the posts of Assistant Professor and decided to follow a fresh process strictly in consonance with University Grant Commission Regulation, 2009.

 

As per the judgment of the High Court of H.P. both the advertisements lost their relevance and as such, all the vacant posts of Assistant Professor in Himahcal Pradesh University were liable to be re-advertised by prescribing eligibility criteria strictly as prescribed by the University Grants Commission. However, despite being the clear cut findings of the  High Court in two judgments, the Executive Council again discussed the issue of selection process in its meeting held on Oct 17,  2015 in complete disregard to the judgment of High Court. Even, again the issue was also discussed in a meeting held on Jan 27.  2016 and now again formed one another committee for scrutiny with respect to interview. The matter now listed before the court on 29th November, 2016 for further hearing.
