The division bench comprising of Chief Justice Mansoor Ahmad Mir and Justice Tarlok Singh Chauhan of Himachal Pradesh High Court today ordered the removal of all illegal constructions raised on Kalka-Shimla national highway within 2 weeks from issuing of this order.
Taking cognizance on the status report filed by the National Highway Authority and others before the High Court on Dec 5, 2015 it ordered to file another fresh status report within 2 weeks compliance period fixing next date of hearing on Dec 28, 2015.
Passing stricture against the authority in the court today judges said that respondent had not done needful required in terms of its earlier directions.
The court also impleaded NHAI, Principal Secretary (Town and Country Planning) Shimla and Director TCP and Superintending Engineer, Sewerage as party- respondents passing order that they would file fresh status compliance reports with respect to earlier court orders.
HC also ordered the Appellate Authority hearing appeals cited in the affidavit that they should also decide the appeals within 15 days and report compliance.
Court ordered Deputy Commissioners Shimla and Solan and other revenue officials to provide all requisite information and documents to the concerned respondents enabling them to submit report about the construction in between Kalka to Shimla along the highway particularly in and around Barog and relating to the bye-pass.
NHAI and all its officers, who are manning the posts in Shimla and Solan are directed to report about the encroachments made on the National Highway right from Kalka to Shimla. NHAI was also ordered to file a detailed report as to who has granted the sanction for raising the structures on both sides of the NH.
