SC caution to CBI to not to cast aspersion on HP High Court

In view of protecting statute of the judiciary, the Supreme Court of India today transferred Chief Minister Virbhadra Singh’s petition that challenged the CBI’s FIR from Himachal Pradesh High Court to Delhi High Court.

Press statement issued by Mr. Singh’s personal secretary said, It was not expressing any opinion on the merits of the case but “simply” transferring the petition to the Delhi High Court “in the interest of justice and to save the institution (judiciary) from any embarrassment.”

The double bench has also clarified that the transfer should not be misconstrued to cast any aspersions on the Himachal Pradesh High Court or as an act that undermined the country’s federal structure,

The bench also ordered the deletion of allegations and counter allegations made by Central Bureau of Investigation (CBI) against the high court judge and the counsel representing CBI in the case.
