Himachal Pradesh government has shifted all the tainted officers to non-sensitive posts complying with the Himachal Pradesh high court orders while hearing a petition which was disposed off today.
Division bench of Himachal Pradesh high court comprising of acting Mr. Chief Justice Mansoor Ahmad Mir and Mr. Justice Kuldip Singh in a order passed over writ petition filed by former Drug Controller officer Mr. Sher Singh ordered to dismiss the case.
The court said in its verdict that since now, the state have filed the status report and have stated that all the said officers have now been shifted to non-sensitive posts the petition is disposed off.
Earlier, appearing for state Additional Advocate General Mr. Anup Rattan stated that all the directions issued by this court from time to time stand complied with.
Petitioner Sher Singh who is also convicted in a corruption case recently had filed this petition alleging that number of tainted officer were holding key posts in the government as action of state was not uniform in all the cases.
On December, 6, 2013, the respondents were directed to identify the officers, who are to be transferred from the sensitive posts to non-sensitive posts as state had accepted that out of 73 tainted officers 43 officers were holding sensitive posts.
On December 27, 2013 court has also given more time to comply with the previous orders made by this court as only 20 officers were remained to be shifted.
Court hearing the petition today decided that state have filed the status report as it had shifted all officers to non-sensitive posts, the petition is disposed of along with all pending applications.
The court said in verdict that counsel to petitioner had stated before the court that in terms of newspaper report, some officers are yet to be transferred.
Division bench held that since no such details are given by the petitioner his application is dismissed but dismissal should not come in the way of the applicant to seek appropriate remedy at appropriate stage.
