Judiciary intervention in transfer policy is against democratic institution : CM

Himachal Pradesh Chief Minister Virbhadra Singh today stated that judiciary intervention in transfer policy is against democratic institution.

Replying to media query about recent court orders or judgments about transfer policy, Mr. Virbhadra Singh said that he disagree with that judgment which is against the rights of public representatives to have say in the transfers policy.

He said that public representatives weather he is elective member of assembly, Panchayati Raj institutions and other civic bodies should have said in the posting and transfer of employees.

If judiciary intervene against this discretion of public representatives he would not be expected to transfer officials on CID reports, Chief Minister said stating that elected people have rights to say in the matter of transfer of employees.

“Unnecessary intervention by the judiciary in transfer policy is against democratic institution”, Mr. Singh said.

“I am biggest supporter of judiciary but I am having every right for public representatives and judicial scrutiny should not be there,” Mr. Singh said commenting on the recent court judgment and order which had set aside the state government decisions recently in large number.
