HC reduces sentence for couple convicted in abetment of suicide case

Shimla, Dec 07: Himachal Pradesh High Court has reduced the quantum of sentence for an elderly couple from Baijnath, Kangra district in a case pertaining to abetment of suicide by their daughter-in-law. Earlier, they had been sentenced for  imprisonment of 2 yrs and 3 yrs separately slapped with fine of Rs 2000 and 3000 under Sec 498-A &  306  of IPC by trial session court to under goes rigorous

Single judge bench of HC comprising of Justice Surinder Singh decided this case on December 2, 2011 and copy of judgment was made available for reporting today. The judgement said that Shanker Dass and his wife have now been sentenced to simple imprisonment for a period of one month each without disturbing the fine. “Considering the entire spectrum of case and the plea of leniency raised on behalf of the accused persons and their ages, the ends of justice would be met in case the substantive sentence as passed by the learned trial Court” Judgment said.

Further, the default clause is also modified to the extent that in case the fine amount is not deposited, each of the convicts shall further undergo simple imprisonment for 15 days. Rekha Devi (deceased) doused herself in kerosene-oil and set herself ablaze in matrimonial home on March 21, 2001 and stated in her last statement before she died due to burn injures that she took worst step after being harassed and tortured by her father-in-law and the mother-in-law. The court had asked the accused persons to surrender before the learned trial Court on December 30, 2011.
