Himachal High Court orders eviction of encroacher from government land

Shimla:  Single bench of Himachal Pradesh High court comprising of  justice Surinder Singh today ordered a  probe into a wrong revenue entry in favour of an encroacher belonging to Kullu district of Himachal Pradesh. The court also directed the concerned administration to take action against errant revenue officials found involved in accordance to the law.

The court also directed the DC  Kullu to order the revenue officer subordinate to him having jurisdiction to initiate the eviction or ejectment proceedings against the plaintiff or any other person found in possession of the suit land as per the provisions of Section 163 of the H.P. Land Revenue
Act.

The Suit land having revenue entry in year 1990- 91 is situated in Phati Natham Kothi Naggar, Tehsil and District Kullu recorded in the ownership of the Provincial Government but in possession of respondent cum plaintiff, Ruldu who latter handed over the land to third party who had raised orchard on it.

  1. Government has no uniform policy for its ownland while it does not hitch to transform huge chunk of land to non-resident who came here as our employer and investor. Even they snatching scare natural resources after depriving thousands from its public utlization.

    Court rightly ouster the intruders in public land but it should also hammer down the act by socalled investors and big housers who want to invest in abode of gods and godess for sake of their profit and reserve their money in non-mobile assets which is best option to park their floating money.
