High Court bars privative varsity to fill up 3 Ph.D seats

Himachal Pradesh High Court today directed the Arni University not to fill up three seats of Ph.D Chemistry stream till the next date. The entrance test is scheduled to be conducted on August 12, 2015 for total four seats.

A Division Bench comprising the Chief Justice Mansoor Ahmad Mir and Mr. Justice Tarlok Singh Chauhan passed these orders on a petition filed by Rakesh Singh, Daljeet Singh and Bhartendu Chaudhary.

The Court directed the state government and Arni Unversity to file the reply within a period of two weeks. As per the facts of the case in the month of August in 2011 the entrance test was conducted for filling up the seats in Arni University for different disciplines and streams.

The petitioners after qualifying the entrance test were admitted as scholars for Ph.D Chemisrtry stream. The petitioners being government employees got the necessary NOC from the respective departments for the same. Now when they have completed their course almost 60%, the university is conducting fresh entrance test for the aforesaid course by saying that the course started with effect from 2011 and now has been declared null and void by the state government.

It is alleged that petitioners were never told that the University has not got the necessary permission from the state government. If the permission is not granted for their course they will have to bear a huge loss and it has been caused due to the lapses on part of the university. The petitioners have prayed to give the directions to state government to give the permission for the course and the university will be directed to pay an adequate compensation for putting them in harassment and humiliation in public at large. And the matter would now be listed now on 8th September, 2015.
