HPCA moves to high court against the take over of international cricket stadium

Himachal Pradesh Cricket Association today moved to high court against the take over of international cricket stadium by the state government recently, as it filed a petition before likely to come fore hearing tomorrow or few days later.

Talking to media, director of HPCA (registered under company’s act) Surinder Thakur said that they moved in the high court this morning as writ petition was filed by Vikrant Thakur, counsel for the HPCA.

He said that petition may be listed for tomorrow or of later to admit it in the court. “It is too early to say that which bench would hear the petition but it is likely to be placed before the Division bench headed by Chief Justice A. M. Khanwilkar, ” he said.

As it has been stated earlier that Himachal Pradesh government on Saturday night decided and took over HPCA international cricket stadium at Dharamshala, Pavilion hotel associated with stadium, HPCA stadium in Bilaspur, Hamirpur, cricket academies at Shimla, Gumma, Mandi and Kullu districts.

The HPCA also moved in the high court on Sep 17, 2013 challenging the jurisdiction of Registrar Cooperative Society (RCS) for issuing show cause notice to this cricket body which is now registered under companies act.

On October 28, 2013 RCS upheld the objections raised by the HPCA as the cricket bodies were ordered by the high court to appear before the RCS first on September 30, seeking ruling over jurisdiction to issue the show cause notice.

As RCS give its ruling in favour of HPCA on the October 29 in an order passed, state subsequently filed a caveat before the high court on Oct 28, 2013 to hear it before giving any relief to HPCA.

State government was defending its action to take over the properties of HPCA alleging that it was trying to grab public assets for the personal gain of Anurag Thakur who is President of HPCA, elder son of former Chief Minister Prem Kumar Dhumal.

Soon after taking over of HPCA stadiums the BJP and its various fronts came forward to rescue the HPCA condemning state actions to take over HPCA assets after filling cases against its functionary.

The BJP alleged that state government should not take possession of HPCA stadium overnight which shows the vindictive attitude of Congress rule towards Mr.Thakur who is also a member of Lok Sabha from Hamirpur Parliamentary segment.

The HPCA which was still recognized by Board Cricket Control of India would challenge this move of state government as it was condemning state government action after pleading the case emphatically after hearing the services of senior advocate of supreme court including BJP spokesman Jaishanker Prasad or other.

Currently state was in a move to constitute an adhoc body to look after the assets and run the business of HPCA as Ranji Trophy matches were being hosted at Dharamshala.
