Finance company ordered to pay Rs 20K

Mandi (Apr 8): Mandi consumer forum while disposing a complaint has directed Mahindra and Mahindra Services Ltd, Luna Pani and Mahindra and Mahindra Finance, PB Marg Warli. Mumbai, to pay Rs 24,653 (towards overcharged amount), and Rs 20,000 as compensation for illegally lifting a vehicle belonging to one Chanchal Kumar, a resident of tehsil Chachoit.

The complainant purchased a vehicle bearing number HP-32-1486, which was financed for Rs 85,000 by Mahindra and Mahindra and the complainant had to pay Rs 1.05 lakh in 30 equal installments. The complainant had paid Rs 79,043 instead of Rs 85,000. On 10-1-2008 the complainant received a latter that the possession of vehicle had been taken over by the opposite parties. When the complainant approached the opposite party it was told that it was on account of mistake on behalf of the employees. Later on 5-2-2008 the agents of the company forcibly took possession of the vehicle.

The complainant once again approached the opposite party and was told to pay Rs 10,000, which he deposited on 9-2-2008 but the vehicle was not handed over to him. So the complainant filed the present complaint seeking damages.

The opposite parties alleged the vehicle was surrendered by the complainant himself on 24-1-2008. It was further sold for Rs 35,000 in order to clear the loan and after adjusting the loan amount Rs 10,000 had yet to be recovered from the complainant.
