Two firms penalised for supplying defective Peddy seeds to a farmer

Mandi: The bench of Consumer Forum Mandi presided by its President Rajeev Bhardwaj has penalized a local firm ( K.D Farm House Sundernagar ( Mandi) and a Hydrabad firm ( Seed Works Internatinal Pvt Ltd Hydrabad)for supplying defective Peddy seeds to Mohan Ram, a resident of village Khandla, Mandi. The  bench has directed the firms to pay the cost of seeds Rs1150 with interest at 9% per annum along with Rs15000 as compensation and Rs 3000 as cost of litigation.

The complainant had purchased 5Kg of Peddy seed from K.D Farm house Sundernagar( local dealer of seeds produced by Hydrabad firm) on 15-6-2009 for Rs1150, but on cultivation it was found that there was no production of Peddy grain due to poor quality of seed and further more it was noticed that the seeds were not meant to be used in Himachal Pradesh. The complainant got his fields inspected from the representatives of Gram Panchyat. The Gram Panchyat Khandla had also passed resolution that compensation should be given to complainant who had suffered loss to the tune of Rs55000. But, when no amount was paid the complainant filed a complaint before Consumer Forum Mandi.

The opposite parties denied that there was no crop of Peddy in the fields of complainant on account of defective seeds. It further stated that it was due to some other reasons such as the field of complainant, required pesticide treatment or the late cultivation. The forum held that on the seeds it was mentioned that it was to be sold in Andhra Pradesh and Tamil Nadu etc, but it was not stated that it was meant to be sold for use in H.P. The forum also held that the opposite parties indulged in unfair trade practice and there had been deficiency in service while selling the seeds to the complainant.
