Drug company MD gets 5-year jail

Mandi (Oct 7): The court of Chief Judicial Magistrate, Mandi, yesterday convicted Ajay Mongi, managing director of Dueful Labs, Jaipur, for manufacturing sub-standard ear-drops and sentenced him to undergo rigorous imprisonment for five years and also to pay a fine of Rs 10,000.

As per facts of the case, drug inspector, Mandi, had inspected a medical store at Rewalsar town on 27-9-1999 and purchased DUEMYCETIN ear-drops for chemical examination, and the medicine’s quality was not found as per the specifications. The drug inspector filed a complaint against the whole-seller and manufacturer of the drug under the provisions of Drugs and Cosmetic Act.

The court acquitted the whole-seller and held the manufacturer guilty for the offence under Section 27(a) of Drugs and Cosmetic Act. Afterwards, the sentence was suspended as the convict filed an application under Section 389 of CrPC, and the court directed the
convict to execute a bond of Rs 50,000 along with one surety.
