Kashang project to continue at respondents’ risk: Green Bench

Shimla: The Green Bench of Himachal Pradesh High Court today asked the executing agency, Himachal Power Corporation Limited and other respondents to carry out construction work on 243-MW integrated Kashang Hydro Power Project on Satluj river in Kinnaur district of Himachal Pradesh at their own risk. While hearing the petition filed by Rajinder Singh, Green bench comprising Justice G.K.Gupta and Sanjay Karol today gave their observation in the case asking the HPCL and others respondents to carry out construction work at their own risk.

Rajinder Singh from project affected Lipa village has filed the writ petition against union government, Himachal Pradesh government, Himachal Pradesh Power Corporation and Hindustan Construction Company alleging the violation of Environment Protection Act 1986 (EPA) in 243 mw integrated Kashang Hydro electric project. The Petitioner alleged that executing agency HPCL has obtained the Environment Clearance “in principle” on April, 16, 2010, but it still has to get the final environment and forest diversion clearance from the Union Ministery of Environment & Forest, which is under consideration. The petition alleged that company has failed to adhere to environment norms, as it has already been executing the power project on Stage I & III, which is against the spirit to EPA and violation of sections 14, 15, 16 & 17 of EPA 1986.The court has fixed next date of hearing after three weeks .i.e. on 23 December, 2010.
