HP Town and Country Planning (amendment) Bill, 2013 tabled in assembly

Urban Development, Housing and Town & Country Planning Minister on Thursday introduced Himachal Pradesh Town and Country Planning (amendment) Bill, 2013 in the state assembly.

It was brought to seek to repeal the Himachal Pradesh Apartment and Property Regulation Act, 2005 and incorporates the provisions relating to registration of promoters, estate agents and development of apartments and colonies into the HP Town and Country Planning Act, 1977 by making suitable amendments, as per recommendations of the selected committee of the Vidhan Sabha.

The HP Apartment and Property Regulation Act, 2005 was referred to select committee of Vidhan Sabha in 2009 after there were complaints of gross violation of provisions of the Act.

Introducing the bill, the minister said it had been proposed to incorporate chapter-II and chapter-III of HP Apartment and Property Regulation Act, 2005 dealing with registration of promoters, estate agents, regulation of construction, sale, transfer and management of colonies, apartments and plots under the HP Town and Country Planning Act, 1977 with consequential modifications and changes.

“It has also been proposed that provisions of the Town and Country Planning Act, 1977 shall equally apply to the areas proposed for development of apartments and colonies outside the notified planning areas or special areas constituted under this Act, i.e. rural areas,” he said.

Mr. Sharma said that the provisions of HP Town and Country Planning Act, 1977 shall equally apply in the cases of development of apartments and colonies and rules, building regulations and bye-laws framed under the said Acts shall also be applicable in such cases. “Penalty in case of contravention of provisions of the Act has been proposed to be enhanced so as to ensure that there is adequate difference,” he said.

    1) regularisation of construction where area i.e set off area not left on the sides of constrction.
    2)when such construion is on pvt road of a company &
    3) in rural area &
    4) no encroachment or litigation is involved &
    5)AREA AROUND CONSTRUTIOS is ghasni,pvt co.’s land & govt land

    Why amendments recently announced to TCP Act have been withdrawn.Are same being amended again to reduce the regularisation fee & how early amended version is expected.
