Case against DAV School, alleging mental harassment.

President, District Consumer Forum Shimla Sureshwar Thakur has directed the management of DAV school New Shimla to file a reply in a compensation claim case filed against it for the recovery of Rs 11 lakh by Master Ural Verma on account of mental harassment.

The petitioner filed the case under section 11 & 12 of Consumer Protection Act(1986) through his father / guardian Vipin Verma, against Principal Secretary, Central Higher Education Board New Delhi, DAV School management committee New Shimla and its Principal Anuradha Thakur.

Petitioner has prayed before the court that he had been student of DAV school right from class one to ten and had recently applied for admission to plus one non-medical group. He has contended that he was one of meritorious students securing 81.7 % marks in tenth class. According to DAV school prospectus in order to take admission in plus one science stream a minimum of 80 percent marks and clear pass in all five subjects in tenth class is required. The prospectus mentioned that cut out percentage depends upon number of aspirants for admission.

He has alleged that despite fulfilling the admission criteria he had been denied admission in an illegal and unconstitutional manner without citing a genuine reason for the denial.

He has charged the school management for rendering discriminatory services and further alleged that the students who had secured less marks have been granted admission in the same class.

Petitioner claimed that due to illegitimate action by the management, he had been compelled to seek admission in another school at Chandigarh, by paying a huge amount of fees for the same, which has resulted in mental torture and financial losses to him and his parents. The next date of hearing was fixed for October 8, 2010.
